Transcript and reference translation

Okay, so they told me that you were arrested but you were confused about the arrest procedure. So please let me explain to you what you should know.

When you are arrested, the police will take you into custody. Usually you have to accompany them to the police station for processing. Later on you will either be sent to court, or you could be released on bail.

There are three steps involved in an arrest. First, the police officer states that you are under arrest. Second, the police officer will tell you the reason for the arrest. Third, you should surrender to the officer. If you do not do so, you will be physically subdued by them.

Now usually the police will have a warrant. They will use that warrant to arrest you. However the police can arrest you without a warrant if they suspect that you have committed an offence. So you might see police arresting suspects to establish their identity, or to stop them from running away, or to preserve evidence, and so on.

In Queensland the police don’t have to caution you about your right to silence unless they want to question you as a suspect in a serious offence. Usually they must tell you that you under arrest and why. Always ask if it’s not clear.

In general you have the right to remain silent. However I have a list here of questions the police can ask and you must answer them. Please read it carefully.

Now, the police are saying that you assaulted one of their officers and that you resisted arrest. In a moment I will ask you about your version of the events. But in the future please remember that if you have a problem with a police officer, you should not confront them directly. Instead, file a complaint at the station.
